October 18, 2019, Amendment to Agreement 19900666, Dated December 28.1990, states: NOW, THEREFORE, IT IS AGREED: FIRST: The net income from the fund established by the Agreement shall benefit the Presbytery of jurisdiction of the Presbyterian Church (U.S.A.) over the state of Hawaii. The first use of the net income from the Agreement shall be used to serve and support the hungry, homeless, and abused people located on the island of Oahu, in the state of Hawaii. If there are other qualified charitable organizations providing services to the hungry, homeless, and abused people on the island of Oahu, in the state of Hawaii, then it is permissible for the Charitable Beneficiary to provide funds from the Agreement directly to said qualified charitable organizations. Qualified charitable organizations are entities as described in Section 501(c)(3) of the Internal Revenue Code of 1986, as amended (or any successor provision of federal law hereafter promulgated). SECOND: If there are no longer any hungry, homeless, and abused people located on the island of Oahu, in the state of Hawaii, then the funds from the Agreement may be used to serve and support the hungry, homeless, and abused people located on the other Hawaiian Islands. If the Charitable Beneficiary or Alternate Charitable Beneficiary or its successors ceases to exist or ceases to be a charitable entity as described in Section 50l(c)(3) of the Internal Revenue Code of 1986, as amended (or any successor provision of federal law hereafter promulgated), or if the Charitable Beneficiary or Alternate Charitable Beneficiary was a member church of or related to the Presbyterian Church (U.S.A.) but has ceased to be a member church of or related to the Presbyterian Church (U.S.A.), or should the aforesaid charitable purpose of the Fund become, within the sole discretion of the Foundation (and without the approval of any court, person, organization or entity), illegal, impossible or impracticable of fulfillment, then the Foundation shall administer the Net Income for purposes which parallel, to the extent possible, the Donors original intentions, in the judgment and sole discretion of the Foundation.

Irwin Bentley Wolfe Memorial Fund | 102261004631

The income shall be reinvested back into principal for fifty (50) years [9/2033]. At the expiration of aforesaid term of fifty (50) years, the said principal and accumulated income shall then be placed at the disposal of the Presbytery of San Joaquin in the state of California, or its successor [now Presbytery of Stockton - 9/2016] [7/2022 - Presbytery of North Central California], to said presbytery, which shall then decide which portion of said accumulated fund shall be paid to Harvest Presbyterian Church in the city of Ceres, California, or its successor organization, and shall also decide the use to which, in their wisdom and considered judgment these fund shall be applied. In the event there should not be a direct successor, to the said Harvest Presbyterian Church, these said funds should then be used by said Presbytery wherever the need is deemed greatest in the furtherance of the Christian Programs of the United Presbyterian Church in the U.S.A.

For the purpose of aiding worthy men and women of high Christian character and intellectual ability through scholarships in studying for the Christian Ministry or other Christian vocations within the United Presbyterian Church in the USA. In the event there are no students available to receive said aid in any given period, the earned income is to be reinvested by the Foundation and added to the principal of the said Memorial Fund.
