(1) To use the grant only for the following purposes: The grant shall be placed in a separate and permanent endowment fund, to be known as the Peter Kiewit Endowment Fund, from which the income only shall be used by the United Presbyterian Foundation for development purposes consistent with the activities of the Foundation's present development function.(2) To repay to the [Peter Kiewit] Foundation any portion of the amount granted which is not used for the purpose of the grant as set forth above;(3) To submit to the [Peter Kiewit] Foundation full and complete annual reports on the manner in which the funds are spent and, if a specific purpose is set forth above, the progress made in accomplishing such purpose. The first report shall be due on or before April 30, 1981 and annually thereafter until the grant funds are expended in full or the grant is otherwise terminated. If the grant is a permanent endowment, such report shall be made for a period of not less than ten years.(4) To maintain records of receipts and expenditures and to make its books and records available to the Peter Kiewit Foundation at reasonable times; and(5) Not to use any of the grant funds: (a) to carry on propaganda, or otherwise attempt, to influence legislation within the meaning of section 4945(d) (1), IRC of 1954; (b) To influence the outcome of any specific public election, or to carry on, directly or indirectly, any voter registration drive within the meaning of section 4945(d) (2), IRC of 1954; (c) To make any grant which does not comply with the requirements of section 4945(d)(3) or (4), IRC of 1954; or (d) To undertake any activity for any purpose other than one specified in section 170(c)(2)(B), IRC of 1954.
