Per Cy Pres dated 10/06/2009, that the endowment funds designated for income to be used in an unrestricted manner by COEMAR be restricted such that the Presbyterian Church (U.S.A.), A Corporation, or any successor in interest to the Presbyterian Church (U.S.A.), A Corporation receiving the income as a beneficiary, may only use the income from such funds for the charitable purposes of COEMAR, as outlined in its Articles of Incorporation, as amended from time to time, and, if COEMAR ever ceases to exist or is merged into another entity, for the last stated charitable purposes of COEMAR as stated in its stand-alone Articles of Incorporation.

For scholarship assistance to graduating African-American High school seniors, without regard to their denominational affiliation, from Louisville, Kentucky, in accordance with the purposes and terms outlined below. It is the donor's intention that each Mary E. Ford Scholarship recipient should receive an award in the amount of $500.00. Five years following the establishment of this fund [October 30, 2003] and on each fifth anniversary thereafter, beneficiary may, at its discretion, increase the amount of each award in increments of $100.00 to address the rising cost of education over time. Beneficiary may allow income from this fund to accumulate in an account administered by the Presbyterian Foundation or its subsidiaries. The accumulation of earnings is intended to permit the beneficiary to determine the timing and amount of distributions for award each year. Draws from accumulated earnings should be in amounts that provide for the maximum number of annual scholarship awards beneficiary can make based upon the award amount of $500 (as adjusted upward over time as permitted above).

1. The Park College – Presbyterian Church Educational Fund: ……for educational purposes as directed in writing by the Fund's Advisory Committee as provided herein and shall at least annually make reports regarding same to the parties hereto and such Advisory Committee. 2. Advisory Committee: A three-person Advisory Committee shall be established to be known as “The Park College – Presbyterian Church Educational Fund Advisory Committee.” All advisory Committee members shall be members of a Presbyterian church, residing within 100 miles from Parkville, Missouri where Park College is located, and shall be designated as follows: One person by Park College, one person by Presbyterian Church or such board or agency as it chooses and one person by the Synods of Mid-America of Presbyterian Church. The three persons initially so designated shall serve respectively for terms of three years, two years and one year, and thereafter each person designated shall serve for three years (or, in the event of death or resignation, until expiration of the appropriate term). No person shall serve on the Advisory Committee for more than two consecutive three-year terms. 3. Advisory Committee’s Powers and Duties: The Advisory Committee shall solicit and review scholarship requests, interview or otherwise communicate with scholarship candidates, determine to whom and in what amounts scholarship aid shall be provided (subject to priorities hereinafter established) and shall instruct the College Board in writing as to making appropriate disbursements from the Park College – Presbyterian Church Educational Fund. The Fund income shall be distributed to those in a higher priority (to the extent of requests and needs) before those in any lower priority are considered, and the Advisory Committee shall abide by the following order of priorities in considering, deciding upon and directing such disbursements: (a) First, to needy students of Presbyterian membership, affiliation or sponsorship who attend Park College. (b) Second, to needy students of Presbyterian membership, affiliation or sponsorship who attend Presbyterian colleges within the Synods of Mid-America of Presbyterian Church (which colleges currently consist of The Lindenwood Colleges, Missouri Valley College, Sterling College, Tarkio College, Westminster College and School of the Ozarks). (c) Next, to needy Missouri-resident students of Presbyterian membership, affiliation or sponsorship who attend Presbyterian colleges elsewhere. (d) Next, to needy students of Presbyterian membership, affiliation or sponsorship who attend Presbyterian colleges elsewhere. (e) Lastly, for educational purposes at Park College or at Presbyterian colleges and schools. The Advisory Committee may establish appropriate procedures or rules in the handling of its duties and responsibilities.
